we'll get to all you need to know and other overnight news. big-time happenings in our nation's capital. it's inauguration day. president obama actually officially took the oath yesterday as is mandated in the contusion. h his family was with him. today's ceremony will be much grander than yesterday with about 800,000 people expected to attend. "today in the bay's" danielle lee is live in washington right now. obviously that was a private ceremony yesterday. what are some of the other main differences between today's oath and yesterday's? >> reporter: well, the size is probably the biggest difference and the one you'll noticed compared to where i'm standing on the national mall. there are tens of thousands of people out here for the public ceremony. the president is going to take the oath of office just before noon but they are already out here dressed warm trying to get the best possible position to participate in this historic

moment. you may be able to hear music playing along the national mall are big screens to help people get as close a look as possible at the president taking that oath of office and you can really feel the energy out here. we are expecting up to 800,000 people to crowd onto the mall today and following the inauguration will be parade that will draw crowds. one of the highlights will be eight floats dedicated to recognizing the home states of the first and second families and also civil rights. one specifically dedicated to martin luther king, jr. as you can imagine the security is tight. people are having to work around that. 150 blocks around the capital and thousands of officers handling crowd control. it will happen during the day and at the end of the night they'll wrap it up with those two official inaugural balls. up to 40,000 people to attend and there are a lot of people

waiting to see what the first lady decides to wear. reporting live in washington, i'm danielle lee. jon, back to you. >> i know there's a lot of things going on. that's an epic bash. i have to ask you. obviously you're a political fan. are you a football fan and if so are you picking 49ers or ravens in the super bowl? >> reporter: you know, it's a tough call. i recently moved here from sacramento so i've got a little bit of allegiance to the 49ers but then when i moved out here, i kind of became akin with the ravens. i'm torn right now. i can't commit to a team. >> i can understand. you are on capitol hill right now. very politically correct answer. well done. we'll cheer for niners out here. good luck. we'll talk to you later on. thanks. the president's agenda is expected to change a little bit during his next term. for a look at what the next four years will bring, we turn things over to santa clara university political science university. we love having you. thank you for your time this

morning. >> thanks for having me. >> we'll start with this. what do you see the president focusing on this second term? >> he's already indicated some of the things that he wants to focus on. for example, the gun control issue and obviously the economy continues to be a big issue. many americans are still out of work. and obviously there are fiscal problems, debt ceiling, has continued to be a big problem and in a few months they'll have to debate that issue again. so there are a number of priorities. i don't know how specific he'll be in his speech today because generally presidents like to focus on large scale issues that everyone sort of agrees on and talk generally about needing to come together as a country. i think he's going to try to make it an inspirational speech. i don't know how specific he'll be about particular issues. >> with that said, in three weeks from now he'll give the state of the union. how do you come up with a speech today and how does that differ from what we expect to hear three weeks from now? >> he's been working for several months on this speech to try to make one big last plea i guess

for national unity. he's trying to make it a memorable speech and inspire people. i would imagine he's looking for something that will motivate americans to sort of come together and perhaps young people. that was a core demographic for him like john kennedy inspiring a new generation to public service. so i think probably it will be more on the inspirational level than the state of the union which will be much more specific about issues. >> i know today there's more significance than usual because it is mlk, jr., holiday. he'll use two bibles. one that abe lincoln used and also what martin luther king, jr. used. touch on the significance of that today. >> the president has a keen sense of history and understand the significance of being inaugurated on martin luther king day because of his status as an african-american president has inspirational value for many people. so it is significant. using the bible that lincoln used is very significant at this particular moment. it should be a good

inauguration. it certainly is a lot less cold than it was four years ago. apparently it was brutal. hopefully his speech will inspire people to move beyond talking about michelle obama's bangs or something like that and focus on the country and public policy. >> i got to tell you, i love her bangs. >> i think they look fantastic. >> all right. professor, don't go anywhere. we'll talk to you throughout the show. thank you so much. >> thank you. >> you also love her guns too. she's always in shape. >> she's fit. she can do serious pushups. last year it was a fantasy and this year it will be a reality. we're talking about the family feud. >> let's get it on. 49ers head coach jim harbaugh set to go head to head with john harbaugh. winner taking home the lovely lombardi trophy. niners will beat atlanta. falcons 28-24. huge victory. entertaining. drama. couldn't ask for more. that wins the nfc championship

game and now the first super bowl in 19 years. fans understandably thrilled. "today in the bay's" bob redell is live at the team store in palo alto where championship gear is already being bought. bob, i guess you will buy t-shirts. >> reporter: i had no idea you had a hidden camera in my bedroom. a lot of fans will be coming here later at the official 49ers team store at the counsel and cou country village in stanford to get shirts and caps like that. the champs arrived at 11:45 last night in the delta charter flight. by the time buses rolled into headquarters in santa clara not far from the airport, a small crowd of fans had gathered. none of the players came out to do a meet and greet but several gave high fives through their car windows as they drove by. >> i got to high five him.

some of them we couldn't see but it was great. >> reporter: fans weren't the only ones glued to last night's game. the people who run graphic sports wear were as well. they had to be to see if they could start printing champion t-shirts. it wasn't clear until the last minute of the game. once it was obvious san francisco won, the company started their silk screen printing machines with the goal of 16,000 t-shirts before midnight. we assume back out here live that these are some of the ones that they are printing because they are the official sanctioned t-shirt printing company for the 49ers as they were for the giants but they basically had to get these out by midnight to be delivered to stores throughout the bay area in time for this morning's opening like here at the 49ers team store expected to open at 9:00 this morning. surprised if wasn't a line of people waiting. bob redell, "today in the bay."

possible criminal charges against one of the niners key wide receivers could end up overshadowing the 49ers big win. michael crabtree is facing accusations of sexual assault. investigators say the accusations are tied to a celebration at a local hotel after the january 13th game against the packers. crabtree's attorney says the star wide receiver met with police and answered questions and he is cooperating with the investigation. a source in the league told espn that it is "highly doubtful" crabtree will be charged. police right now in atlanta investigating an ugly incident that happened after the niners big victory and just outside of the stadium down there in atlanta. witnesses say a person dressed in 49ers gear stabbed a falcons fan in the neck after being punched. police will only say at this hour the victim is 35 years old. paramedics rushed him to the hospital. he's expected to survive. police have not yet made any arrests. in san leandro, police are searching for as many as seven

people after a weekend shooting at b.a.r.t.'s bayfair station. the shooting left an innocent man dead. two groups of people started shooting at each other in the bus stop area of the station saturday afternoon. a man in his 40s was killed and a 16-year-old girl was wounded. both are believed to be innocent victims caught in the cross fire. investigators managed to detain a 16-year-old boy and found evidence at a nearby home. no word on exactly what that evidence is or any description on other suspects. poli >> how would you describe yesterday's weather? >> perfect. >> i would say spectacular. tough act to follow, christina loren. >> how about a repeat performance? how does that grab you on a monday? looking good. looking good. 32 degrees to start in livermore. cold morning to get through to enjoy beautiful sunshiny afternoon with temperatures in the 70s in some cities. want to thank you for waking up with us even if you don't have

a shark sighting in canada to tell you about. we're telling you about the san jose sharks getting ready for game two of that sprint to the playoffs. a game shortened season. last night the season off to a great start in calgary. they beat the flames 4-1. the sharks after that victory now play in edmondon tomorrow.

the famed bat mobile is in the hands of another millionaire this morning. this weekend someone paid $4.2 million for the original vehicle from the 1960s "batman" television series. >> hopefully that comes with a navigation system. >> it was sold at an arizona auction. who is this guy? the seller was the man who customized the 1955 lincoln car and turned it into the crime fighting machine. the winning bidder has not been identified publicly. >> wow. 4.2 million is not a bad ride. no trading on wall street but lots of anxiety about apple. >> wall street has lots to be anxious about. apple really is at the top. apple shares have been on a downward path for quite some time now and we've had a number of reports of reduced orders for components. a sign that apple is selling fewer devices.

we'll know more wednesday. that's when the cupertino company reports profits. tech has not done particularly well this earnings season. over the weekend a bizarre press conference and announcement at a party in new zealand really big tech guy unveiling a new file locker system called mega. dotcom has been accused by the united states of being a movie and music pirate through his old service megaupload. dotcom faces charges despite that he's a german living in new zealand. a long history of various criminal charges, judges and the prime minister of new zealand have expressed doubts about the case against him. also over the weekend a memorial in new york for internet pioneer aaron schwartz. the young man facing hacking charges who took his own life earlier this month. many if the tech community feel the feds were overreaching in the schwartz case. a federal judge said if schwartz

were guilty so too are most of us for breaking same laws he was accused of breaking. bottom line, jon and marla, to two cases pursued by the obama justice department. there is disagreement that charges be being pursued in the administration. google avoided a huge problem when ftc declined to pursue charges. some disappointment from tech. >> thank you so much. >> meteorologist christina loren joining us on set for great weekend. we'll get rain this week. >> we're going to get a little bit this week. more so for the coming weekend. that's why i was urging you to get outdoors last friday. i saw the showers coming for saturday and sunday. all the models have been bringing in the rain and cold but we'll hold that off until saturday and sunday. that's when our wet pattern

starts. may get fog and drizzle on wednesday. that's the only heads-up i'll give you for now. you'll have to wait for the seven-day outlook. 31 degrees in gilroy to start. good morning, livermore. 37 degrees in san mateo. a cold start to the day. we have a good looking afternoon shaping up with temperatures approaching the 70s in the south bay. that's going to be the warmest spot across the bay area. south bay beaches the place to be. cold temperatures as we head throughout the latter portion of the week. we'll lose that mild pattern as of wednesday. want to keep that in mind if you want to get outdoors and then the return of the rainy days into the weekend. high pressure taking the storm track well to the north well into canada as a matter of fact and for us it will be another mild afternoon with temperatures in the 70s unseasonably warm and then things start to change with an area of low pressure taking slowly toward the coastline. this could bring us some pretty significant rainfall on sunday. saturday it looks like just some light precipitation but sunday not a great day for outdoor

activities. 70 in gilroy. 63 in fairfield for today. seven-day outlook works like this. fog and drizzle on wednesday. thursday mild conditions. you'll still be able to get outdoors and dodge the rain on friday. and then saturday into sunday, the rain moves in late saturday night. lasts sunday, monday, tuesday and potentially all of the way through wednesday of next week. rather dry january so far. everything changes as we get into this week. back to you guys. >> thank you so much. 5:19. today a search will continue for the body of one of the two san francisco men who drown while on vacation in hawaii this weekend. the victims have been identified as 46-year-old adam griffis and brian baker. they went climbing on rocky coastal area near princeville when a wave pulled one of the men out to sea. the other reportedly jumped in to try to save his friend and they both ended up drowning. crews recovered griffis body

yesterday but halted the search for baker's body because of rough surf. marin county set to hold another gun buyback event today but it's missing one key ingredient. money. the county's first ever gun buyback event was successful that officials ran out of money and issued ious. county officials do admit they are still trying to raise that money to pay off those ious. today they are only offering their thanks. a big pat on the back to anyone turning in a firearm at the mill valley police department. the event is set to run from 11:00 to 3:00 today and police say any gun can be dropped off no questions asked. federal investigators are now looking into a frightening landing at new jersey's newark liberty airport. a united express plane blew four fires as it landed and veered off the runway. the commuter jet arrived before 8:30 last night. a port authority spokesperson says the plane veered on a

taxiway and didn't hit anything. the express flight was carrying eight passengers and five crew members. no one was hurt. it's not clear what caused the tires to blow. the investigation into boeing 787 dreamliner, the jets, have now turning it over to the company that make batteries for jets. an overheated lithium ion battery forced grounding of all flights and the latest issue for plane that has seen a half dozen problems. just last week those problems led japanese and flight officials to ground the entire 787 dreamliner fleet. boeing says it is cooperating with the investigation now and will not deliver anymore of the cutting edge planes until all of the issues have been resolved. the state of utah is set to honor a japanese american civil rights hero. the state has named january 30th

the town is called "fruitvale." the early reviews extremely positive. the film debuted this weekend at the sundance film festival. a number of studios talking to producers about distributing that film. it appears oakland raiders will be represented at this year's pro bowl after all. fullback marcel reis is being added as a roster replacement. he played all 16 games for the raiders this season. he posted career highs in rushing and ranked second in catches. he'll replace baltimore ravens fullback who won't make the trip because he'll be busy preparing for the super bowl. initially no players for the raiders were selected for the pro bowl. keeping things on the pig skin field right now. let's call her the fortune teller. >> she predicted the win and the exact point spread. listen to this from our friday

a very good morning to one and all. 5:30 right now. thanks for joining us. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. president obama on his way to church to begin his inauguration activities. a huge day for the first family. a day that officials estimate will bring some 800,000 spectators to the nation's capital. "today in the bay's" danielle lee is live in washington. looks like she has a good seat out there. danielle with all of the festivities going on, what type of things should we look forward to today? >> reporter: jon, there's a lot of enthusiasm here. you can expect a lot of energy. you can expect star performances. a speech from the president. he's expected to talk about unity and perseverance for the nation as he heads into his second term facing a budget battle coming up and really the main thing right now is the energy. it's in the air. there is already a sea of people filling several blocks of the national mall. we're two hours away from the

official ceremony even beginning. all along the national mall are large screens that will air the inauguration. right now they are airing music. many people are taking part in that. just a couple minutes the president is going to attend a church service at st. john's. that's an inauguration day tradition and after that he'll head this way. just before noon he'll take the oath of office and after the inaugural ceremony is over, there will be that parade of a big highlight there. there will be eight floats that are representative of the home states of the first and second families and also civil rights and one specifically dedicated to martin luther king, jr. then the end of the evening they will wrap it all up. president and first lady attending the two official inaugural balls. 42,000 people are expected to attend. many are waiting to see what the first lady will wear. reporting live in washington along the national mall, i'm danielle lee. jon, back to you. >> always about the fashion.

an epic and memorable day out there. we hear security is tight. how tough is it for you to get where you need to be? was it hard? >> reporter: i walked a little over a half mile to get to my live shot around 2:00 in the morning. they already started closing roads. people coming in here need to allow a lot of time. they are walking a long ways. we've begun getting alerts from inaugural committee saying if you don't have tickets, don't use certain metro stops. there is a lot of security. 150 blocks all around me shut down. a 30-mile no-fly zone and thousands of officers here enforcing those rules and enforcing crowd control and keeping an eye out for anything that looks out of place. >> all right. danielle lee there for us. enjoy the festive day and memories. we'll talk to you in a bit. thanks a lot. today is all about pomp and circumstance for president obama but tomorrow it's back to business. just like that. santa clara university political

science professor joining us from our newsroom this morning with more on what we can expect to see in the president's second term. jim, good morning. this new term comes with big changes for the president's cabinet. let's quickly go through some of the big name nominees including sort of a controversial pick, chuck hagel for defense secretary replacing leon panetta. >> that's the more controversial of the nominees so far. it's interesting because he is a republican and usually when presidents nominate members of the other party, that party doesn't complain very much but in the case of hagel many in his own party think he's too liberal and his stance on israel are not in accord with the rest of the party. so there is some concern that maybe he may be too controversial a pick. if hi to bet, i think he probably will be confirmed. obviously the other big name is john kerry being nominated for secretary of state replacing hillary clinton and the speculation is that he will sail through and there won't be too much trouble with that nomination. >> now, how quickly can we

expect these confirmations? >> you know, there's no telling how quickly some of these will go especially in the case of hagel. there may be debate. i think in the case of kerry it will be very quickly. if i had to bet, probably much of the debate over hagel will take place in the press before the vote. they'll probably do that pretty quickly. you don't want to have doubt about the secretary of defense for too awful long. >> let's talk a little bit about the cost of the inauguration. in 2008, it cost $170 million. this one the price tag not known at this point. regardless, getting a little bit of heat especially in this sort of climate that we're in today in terms of the economy. do you think that president obama should have scaled this back? >> he did scale it back quite a bit. i believe there were nine or ten inaugural balls in 2009 and this time there are only two. he has made an effort to scale it back. obviously some critics would say why are we having any of these expensive events that are

celebrating when we really ought to be getting to work. but the flip side of this is there are many businesses that depend on a budget for this and this is a big event for them and they have caterers and planners and this creates jobs for a lot of people. there is a balance here and i think that's probably what the president has in mind. at least keeping two of these going. and people who work hard on the campaign obviously want to celebrate and look forward to the next four years with president obama. >> very good point. we'll talk to you in our 6:00 hour. thanks so much. >> we'll have extensive coverage of today's inauguration both on air and online here on nbc bay area. we're streaming live video from the nation's capital and photo gallery at nbcbayarea.com. the "today" show will begin special live coverage of the inauguration set for 7:00 this morning. look at this. our political analyst larry gerston was in washington for the inauguration. even though d.c. is big-time on politics, he managed to slip on

the kaepernick jersey and celebrate the 49ers victory posting this one on twitter. nice work, larry. the guy next to him in the skully and sunglasses there, that's none other than bay area's mc hammer. stop. hammer time. larry gerston just one of millions who watched the niners getting the job done yesterday. they punched the ticket to the super bowl becoming champions of the nfc. >> the niners pulled off a big comeback win in atlanta yesterday. they didn't score until the second quarter and headed to halftime down 24-14. >> that was just for drama. they did it for us. >> just to stress us out. no reason to worry. they scored in the third and in the fourth quarter frank gore ran it in for the go-ahead touchdown. niners 28, falcons, 24. after the game players said it's a great win but their work is not done. >> we are going to enjoy and embrace it. take advantage of it. we've got one more game to try and win. >> it doesn't stop here.

we still have one more big game. one more 60-minute game to play. if we win that one, that will be going crazy. >> the whole bay area will go bananas on that. you know what a championship means? championship gear. fans getting ready for the nfc championship merchandise and they are going crazy. >> big crowds expected at the niners team store to get their hands on new nfc championship gear. bob, i'll text you my size. >> reporter: sounds good. good morning. you think you guys were glued to the tube yesterday or myself for that matter, imagine if you have to print these t-shirts. we checked in with graphic sports wear and they were telling us it was obviously as we all know a nail biter until the last minute of the game before they were able to figure out, yes, the niners will take the falcons out and they can print these t-shirts. they had the ink. the screens ready to go.

and then they started printing after that game with the goal of getting 16,000 printed before midnight because those t-shirts had to be delivered in time. you see some delivered here to the 49ers team store in palo alto. get them out in time so fans can pick them up later this morning. >> we're excited that it's happening again. once we get to super bowl and super bowl champions, numbers will double. looking forward to that. >> so 16,000 printed last night. hopefully if niners win the super bowl they think they'll get 42,000. this is video of the niners arriving back home to the bay area last night. this outside of their training facility and headquarters in santa clara. they got in just before midnight. around 11:45. there were quite a crowd of fans out there in this cold weather trying to get a glimpse of their favorite 49ers. the niners didn't come out and do any meet or greet but we understand they did give high fives as they were heading home

crocker amazon neighborhood. 43-year-old man died at that scene. 35-year-old man was taken to the hospital where what's being called nonlife threatening injuries. the suspected shooter was last seen running away from the scene but police only have a vague description of the man. this is the city's third homicide of the year. also new this morning, firefighters in san francisco searching for the cause of a two-alarm fire that left several people homeless. firefighters say it all started in a three-story apartment building on 19th and california in the city's richmond district. you can just see all of the smoke and flames pouring right through the roof. this one took crews about 45 minutes to finally knock down. happy to report nobody was hurt but nine people have not yet been allowed to return to their homes. in south san francisco police and fire investigators are examining a suspicious fire at city hall overnight. firefighters say the fire started in a dumpster next to a building on the city hall complex. the flames spread inside the building and damaged some

paperwork. firefighters say the building is used by the city's building department. they are still investigating the cause. they say it appears to be suspicious. >> work is starting this week aimed at repairing sections of that bay bridge damaged when it was hit by an oil tanker earlier this month. starting tomorrow, caltrans replacing fenders on the western tower that were sideswiped back on january 7th. officials say the actual pier itself sustained no damage as the fender system worked and absorbed that impact. the repair work expected to last 4 1/2 months. the ntsb and coast guard say it could take months to determine the cause of the crash. people all over the nation and across the bay area will celebrate martin luther king day by giving back to their communities. in san mateo county, a food drive for second harvest food bank and a celebration of the arts. in oakland, cleanup events will

be held at martin luther king jr. shoreline and caltrans will host the freedom train ride. the train leaves at 9:30 this morning and ends with a march. the 2013 mavericks surf competition is right now in the books. a local wave rider manages to come out on top. about two dozen of the world's top surfers out there getting the job done showing off the moves on the waves that reached up to 25 feet up there in half moon bay. beautiful day out there. thousands gathering to watch that competition unfold. they had to watch it on the jumbotr jumbotron. first time ever fans were prohibited from watching the action from mavericks beach after a rogue wave last time they had it injured several spectators. fans say they are disappointed

at least one american is believed to be among the dead. almost two dozen foreign workers are still unaccounted for. algerian troops stormed the plant on saturday following a four-day standoff with militants holding hostages at that plant. law enforcement agents from all over the bay area and across the entire country coming together today to honor a fallen brother. funeral services being held this morning for kevin tonn, an officer for the galt police department. he was killed in the line of duty last week. he was well known as an ambassador for canine teams and often raised money to provide police dogs with bulletproof vests. officers from all over the bay area are expected to attend this funeral. this will be held in roseville near sacramento later on this morning. the person they believe is behind the hoax involving notre dame football star manti te'o may soon tell his side of the story. a family member says he'll meet with his family and an attorney
